Terms & Conditions of Sale

This Agreement applies to all vehicle purchases from Creature Racing, Electric Bike Outlet, and ATV Wholesale Outlet. Customers purchasing an Extended Warranty or Battery Protection Plan are also subject to the separate Extended Warranty Terms & Conditions.

1. Agreement

This Agreement governs every purchase and use of products sold by Creature Racing.

By placing an order or accepting delivery, Customer agrees to these Terms & Conditions.

2. Product Information

Product photos, specifications, colors, graphics, firmware, components, and accessories may change without notice by the manufacturer.

Customers are responsible for reviewing product specifications before ordering.

3. Pricing, Promotions & Discounts

Prices are locked when an order is placed.

Creature Racing is not obligated to honor discounts, coupons, financing offers, rebates, or promotions released after an order has been submitted.

Creature Racing reserves the right to correct pricing or typographical errors prior to shipment.

4. Order Acceptance

Orders are subject to inventory verification, fraud prevention, payment verification, and acceptance by Creature Racing.

Creature Racing reserves the right to refuse or cancel any order.

5. Shipping, Delivery & Inspection

Estimated delivery dates are estimates only and are not guaranteed.

Weather, carrier delays, manufacturer delays, supply chain interruptions, customs, and events beyond Creature Racing’s control do not constitute grounds for cancellation or refund.

Customer shall photograph the freight driver unloading the shipment whenever reasonably possible.

Customer shall photograph the unopened crate or box from all sides before opening.

Customer shall photograph the vehicle immediately after unpacking and before assembly.

Any shipping damage, missing parts, or concealed damage must be reported within 24 hours of delivery with supporting photographs.

Failure to timely report damage may result in denial of freight or damage claims.

6. Assembly, Inspection & First Ride Requirements

Professional assembly and inspection by a qualified bicycle or powersports repair facility is strongly recommended before first use.

By choosing self-assembly, Customer represents that they possess the knowledge, experience, tools, and competency necessary to safely assemble, inspect, adjust, and test the vehicle. If Customer lacks such qualifications, Creature Racing strongly recommends professional assembly and inspection before operation. Without professional assembly, warranty may be void.

Prior to installing any component, Customer must inspect all threaded holes, threaded inserts, studs, bolts, nuts, welds, mounting surfaces, bearing seats, and assembly areas for stripped threads, cracks, deformation, cross-threading, or other defects.

Customer must inspect all new parts before installation for cracks, bent components, damaged threads, missing hardware, shipping damage, or manufacturing defects and photograph any damage before installation.

Customer assumes responsibility for documenting the assembly process with photographs when possible.

Before the first ride Customer shall verify and torque all applicable fasteners to manufacturer specifications, including handlebars, stem, triple clamps, axles, wheels, brake components, suspension, steering components, chain, battery mounting, and electrical connections.

Creature Racing is not responsible for injury, property damage, or mechanical failure resulting from improper assembly, adjustment, inspection, maintenance, or failure to follow manufacturer instructions.

7. Manufacturer Warranty

Products are covered only by the manufacturer’s original warranty unless the Customer separately purchases a Creature Racing protection plan.

Manufacturer warranty eligibility may be affected by improper assembly, misuse, abuse, neglect, racing, unauthorized modifications, or failure to follow manufacturer requirements.

Creature Racing and ATV Wholesale Outlet shall not reimburse Customer for any repairs, replacement parts, labor, diagnostics, shipping costs, or other expenses incurred without prior written authorization. Any repairs or services performed outside of Creature Racing’s authorized dealer or service network without express written approval shall be performed solely at Customer’s expense and may void applicable warranty coverage.

8. Extended Warranty

If purchased, the separate Extended Warranty & Battery Protection Terms apply.

9. Returns

All vehicle sales are final unless a return is expressly approved in writing by Creature Racing.

Returns are not permitted, regardless of product condition, without prior written authorization.

Approved returns may be subject to restocking fees, inspection fees, original outbound shipping charges, return freight, payment processing fees where permitted by law, and any other reasonable costs unless expressly waived by Creature Racing.

10. Refused Shipments & Cancellations

Refused shipments are treated as unauthorized returns.

Customers remain responsible for outbound freight, return freight, storage, carrier charges, restocking fees, and reshipping fees if applicable.

Orders entering fulfillment or freight shipment may no longer be eligible for cancellation.

11. Customer Responsibilities

Customer agrees to comply with all manufacturer instructions and all applicable federal, state, and local laws.

Customer shall wear appropriate safety equipment, perform routine inspections and maintenance, and discontinue operation if any unsafe condition exists.

12. Limitation of Liability

Creature Racing is not liable for improper assembly, misuse, abuse, transportation damage after delivery, consequential damages, incidental damages, lost income, towing, rental costs, or loss of use except as required by law.

13. Assumption of Risk & Indemnification

Operation of powersports and electric vehicles involves inherent risks of injury, death, and property damage.

Customer voluntarily assumes these risks and agrees to indemnify and hold harmless Creature Racing from claims arising from Customer’s assembly, operation, maintenance, transport, or misuse of the product, except to the extent prohibited by law.

14. Governing Law

This Agreement is governed by California law. If any provision is unenforceable, the remaining provisions remain in effect.

15. Digital Acceptance

By checking the acceptance box during checkout, Customer acknowledges that they have read, understood, and agree to these Terms & Conditions.


Extended Warranty & Battery Protection Terms & Conditions

The following Extended Warranty & Battery Protection Terms & Conditions apply only to customers who have purchased a Creature Racing Extended Manufacturer Warranty and/or Battery Protection Plan.

The purchase of a vehicle alone does not provide the benefits described in this Agreement. These terms do not create, extend, or modify any warranty coverage for customers who have not purchased an eligible protection plan.

Customers who do not purchase an Extended Warranty or Battery Protection Plan remain subject only to the original manufacturer’s warranty (if applicable) and Creature Racing’s general Terms & Conditions of Sale.

The benefits, rights, obligations, exclusions, and claim procedures described herein become effective only upon the Dealer’s acceptance of the applicable protection plan purchase.

Dealer Information

This is a self-insured dealer protection plan offered by Creature Racing / Electric Bike Outlet / ATV Wholesale Outlet.

This Agreement is not an insurance policy and is not backed by any manufacturer, third-party administrator, or government agency.

Dealer is solely responsible for obligations expressly stated within this Agreement.

Plan Benefits

  • Extended Manufacturer Warranty (Parts Only): Extends manufacturer parts coverage for covered defects beyond the original factory warranty term purchased. Labor, diagnostics, installation, programming, shipping, transportation, and shop fees are excluded unless Dealer expressly authorizes otherwise in writing.
  • Battery Protection Plan: Provides either five (5) or seven (7) years of battery protection for qualifying battery failures as defined herein.
  • One-Time Lost Key Replacement: Includes one replacement key/ignition component (parts only). Labor, programming, locksmith services, and shipping are not included unless expressly authorized.

Battery Failure Definition

A covered battery failure means the battery is determined by Dealer to be defective after inspection and testing.

A covered failure includes a battery that will not power on, or will not remain powered on for more than approximately ten (10) seconds after being fully charged, provided there is no evidence of abuse, impact, water intrusion, tampering, improper charging, electrical short, modification, or other excluded condition.

A covered battery failure also includes a battery that, due solely to an internal defect as determined by Dealer, is no longer capable of delivering at least forty percent (40%) of its original advertised riding range when tested under Dealer’s standardized testing procedure.

Dealer’s standardized testing procedure includes, at a minimum: a fully charged battery using an approved charger; the vehicle operating in the lowest available power mode (Eco Mode, Level 1, or equivalent); manufacturer-recommended tire pressures; no mechanical defects affecting efficiency; and testing on substantially flat paved roads, hard-packed dirt roads, or gravel roads suitable for normal passenger vehicle travel.

Testing shall not be conducted on hills, steep grades, technical off-road terrain, sand, mud, snow, standing water, deep gravel, or any surface that materially reduces vehicle range.

If the manufacturer publishes an official range testing procedure, Dealer may use that procedure when practical. If no procedure is published, or Dealer determines another standardized procedure is more appropriate, Dealer’s standardized testing procedure shall govern.

Unless otherwise specified by the manufacturer, Dealer may conduct standardized range testing using a rider weighing approximately 170 pounds (±10 pounds) with no passengers or cargo.

Dealer reserves the exclusive right to determine testing procedures, environmental conditions, rider weight, tire pressures, charging methods, and other variables reasonably necessary to evaluate battery performance under consistent and repeatable conditions.

Reduced range caused by rider weight, riding style, terrain, weather, accessories, cargo, towing, tire pressure, improper maintenance, or normal battery aging is not considered a covered failure.

Battery Inspection & Diagnostic Testing

Dealer reserves the exclusive right to inspect, diagnose, and test any battery submitted under this Agreement.

Dealer may utilize any diagnostic procedures, software, battery analyzers, capacity testing equipment, manufacturer diagnostic tools, load-testing equipment, or other inspection methods deemed appropriate.

Dealer’s inspection and testing results shall determine whether a battery qualifies as a covered failure, subject to applicable law.

Warranty Claim Process

Customer must contact Dealer before any repair is attempted.

Dealer may require proof of purchase, VIN/serial number, odometer or hours, photographs, videos, maintenance records, and any additional documentation requested.

Failure to provide requested information may result in claim denial.

Dealer may require shipment of the battery, failed component, or complete vehicle for inspection. Customer is responsible for all packaging, shipping, insurance, and transportation expenses.

Dealer determines claim eligibility based upon inspection, testing, and compliance with this Agreement.

Parts Only Coverage

Approved claims provide replacement parts only unless Dealer expressly authorizes otherwise in writing.

Labor, diagnosis, installation, programming, transportation, shipping, rentals, downtime, and previously purchased parts are not covered.

No reimbursement is available for repairs or parts purchased before written warranty approval. This plan has no cash value.

Professional Installation Requirement

For repairs deemed by Dealer to involve significant safety, electrical, or technical risk, Dealer may require installation by a qualified or certified repair facility at the Customer’s sole expense.

Dealer reserves the sole right to determine which repairs require professional installation.

If professional installation is required, Customer must provide a paid invoice and proof of installation before warranty coverage continues.

If Customer elects to self-install a required professionally installed component, Dealer may still provide the approved replacement part; however, warranty coverage immediately terminates unless satisfactory proof of professional installation is later provided.

Transferability

Extended Warranty and Battery Protection Plans are non-transferable without the prior written approval of Creature Racing and/or ATV Wholesale Outlet. At the sole discretion of Creature Racing and/or ATV Wholesale Outlet, an approved protection plan may be transferred one (1) time only to a subsequent owner of the original covered vehicle upon payment of a non-refundable $150.00 transfer fee. The new owner must satisfy all documentation and eligibility requirements established by Creature Racing. No protection plan may be transferred more than once, and Creature Racing reserves the right to approve or deny any transfer request in its sole discretion.

If the covered vehicle is sold or otherwise transferred to a new owner and neither the original purchaser nor the new owner contacts Creature Racing or ATV Wholesale Outlet within thirty (30) days of that sale or transfer, or the $150.00 transfer fee is not paid, the protection plan is void. A voided plan provides no coverage to the original purchaser or to any subsequent owner and cannot be reinstated.

Warranty Exclusions

  • Normal wear and tear.
  • Consumables including brake pads, tires, chains, sprockets, bearings, filters, fluids, lubricants, bulbs and similar maintenance items.
  • Cosmetic damage including paint, plastics, decals, trim, scratches, dents, fading and discoloration.
  • Accidents, crashes, collisions, impacts, drops, rollovers or falls.
  • Water intrusion, flooding, weather damage, corrosion, rust or oxidation.
  • Misuse, abuse, neglect, improper operation or overloading.
  • Aftermarket, modified, altered or non-OEM components.
  • Unauthorized electrical modifications, accessories or wiring.
  • Racing, competition, stunt riding or commercial abuse.
  • Improper charging, overcharging, incompatible chargers or incorrect voltage.
  • Theft, attempted theft, vandalism or intentional damage.
  • Pre-existing conditions.
  • Failure to perform recommended maintenance.
  • Diagnostic labor where no covered defect exists.
  • Shipping, transportation or storage damage.
  • Unauthorized repairs, modifications or disassembly.
  • Evidence of abuse, tampering, unauthorized modification or improper repair.

Additional Conditions

  • Coverage applies only to the original purchaser, except where a transfer is approved under Transferability above.
  • Plans are non-refundable, non-exchangeable and have no cash value. Transfers are permitted only as described under Transferability above.
  • Dealer may require return of replaced components.
  • Dealer is not responsible for damage caused by improper packaging during shipment.

Limitation of Liability

Dealer shall not be liable for towing, transportation, rentals, fuel, loss of use, lost income, incidental, consequential, indirect, or special damages.

Customer Acceptance

I have read and agree to these Extended Warranty & Battery Protection Terms & Conditions. I understand this is a self-insured dealer protection plan, approved claims generally provide parts only, labor and transportation are excluded unless expressly authorized in writing by Dealer, and this plan is subject to all terms, exclusions, claim procedures, and Dealer approval requirements contained herein.
