ATV WHOLESALE OUTLET CUSTOMER SALES AGREEMENT, WAIVER AND TERMS OF PURCHASE

PLEASE READ CAREFULLY BEFORE SIGNING

This Sales Agreement is entered into by and between ATV Wholesale Outlet, Inc and the purchaser. By completing a purchase, you agree to the following terms.

1. SHIPPING, DELIVERY, AND DAMAGE POLICY

  • Inspection Required: You must inspect the product upon delivery and document any visible damage with photos.
  • Acceptance of Shipment: You agree not to refuse a shipment under any circumstances. Refusal may result in added fees.
  • Damage Notification: All damage must be reported within 24 hours of delivery with supporting documentation.
  • Damage Claims: We will assist with legitimate shipping damage claims. Cosmetic imperfections such as minor scratches or scuffs are not grounds for return or refund.
  • Shipping Estimates: Delivery dates are estimates only and delays do not qualify for cancellation or refund.

2. WARRANTY POLICY

  • Coverage: Products are covered only by the manufacturer warranty for original equipment parts. This excludes issues caused by aftermarket parts, misuse, negligence, accidents, improper assembly, or unauthorized modifications.
  • Labor: Labor costs are not covered under any warranty, including those incurred through third party service centers.
  • Warranty Process: Defective parts may need to be returned for inspection before replacements are issued. Each case is reviewed individually.
  • Repair Requirements: Professional assembly and repairs are strongly recommended. Improper assembly or maintenance may void warranty eligibility.

3. ASSEMBLY REQUIREMENTS

  • Professional Assembly: Strongly recommended. If you self assemble, it must be completed exactly according to the manufacturer instructions, manuals, guides, and videos.
  • Warranty Impact: Improper assembly can lead to warranty claim denial if issues result from incorrect assembly.

4. RETURN POLICY

  • Final Sale: All sales are final.
  • Return Requests: Under exceptional circumstances and at our discretion, a return may be approved if requested within 48 hours of delivery.
  • Return Conditions: If approved:
    • You are responsible for return shipping
    • The product must be professionally repackaged with detailed photos
    • A 10 percent restocking fee applies
    • The product must be unused and in original new condition
  • Discretionary Denial: We may deny any return request at our discretion.
  • Original Shipping Charges: If free shipping was provided, the original outbound shipping cost will be deducted from any refund.

5. LIABILITY WAIVER

  • Assumption of Risk: You acknowledge that operating electric bikes and similar vehicles carries inherent risks of injury, death, or property damage.
  • Release of Liability: You release ATV Wholesale Outlet and its affiliates from any liability related to the use, operation, or maintenance of the product.
  • Modification Disclaimer: Any modification to the controller, motor, electrical system, or other components voids all warranties and releases us from liability.
  • Safety Acknowledgment: You agree to wear proper safety gear and operate the product safely and legally.

6. CUSTOMER RESPONSIBILITIES

  • Legal Compliance: You are responsible for following all local, state, and federal laws including helmet, licensing, and registration requirements.
  • Maintenance: You must perform pre ride inspections and ongoing maintenance such as checking tire pressure, tightening bolts, and inspecting brakes.

7. GOVERNING LAW AND DISPUTE RESOLUTION

  • Governing Law: This Agreement is governed by the laws of California.
  • Venue: Any legal action must be filed in Sacramento County, California.
  • Arbitration: All disputes will be resolved through binding arbitration in Sacramento County under the rules of the American Arbitration Association. Each party is responsible for its own attorney fees and costs.

8. PAYMENT TERMS

  • Final Sale: All sales are final upon shipment. No cancellations, chargebacks, or refunds are permitted except as described in these terms.

9. DIGITAL SIGNATURE

  • Binding Agreement: Checking the acceptance box and providing a digital signature at checkout confirms your acceptance of these terms with the same legal force as a handwritten signature.
